Terms of Service

1. Agreement

These Terms are a binding agreement between you and the operators of this website and game realm ("the service", "we"). By visiting the website, creating an account, downloading the launcher or connecting to the realm you confirm that you have read and accepted these Terms, the Rules, the Privacy Policy and the Refund Policy. If you do not agree with any part, do not use the service.

2. What this is

This is a free, fan-run private realm for World of Warcraft patch 3.3.5a with the Conquest of Azeroth modification, run as a hobby for entertainment and educational purposes. It is not a business and nobody is paid to run it.

3. Who may not use the service

You may not visit this website, create an account, download anything from it or connect to the realm if you are, or act on behalf of:

• Blizzard Entertainment, Inc., Activision Blizzard, Inc., Microsoft Corporation, or any parent, subsidiary or affiliate of them;
• an employee, contractor, agent, investigator or legal representative of any of the above;
• any person or organisation that uses the service to collect information or material for a claim, complaint or legal action against the service, its operators, team or players.

By using the service you declare that none of the above applies to you. Access by such a person is unauthorised and without our consent, and no permission is given to copy, record or use anything obtained through such access.

4. Not affiliated with Blizzard

This project is not affiliated with, endorsed by, sponsored by or associated with Blizzard Entertainment, Inc., Activision Blizzard, Microsoft or Project Ascension in any way. World of Warcraft, Wrath of the Lich King and all related names, logos, characters, artwork and content are trademarks and copyrights of Blizzard Entertainment, Inc. All rights in the original game belong to their owners. We claim no ownership of any of it. You are responsible for owning a legitimate copy of the original game.

5. Age

You must be at least 13 years old. If you are under 18 (or under the age of majority where you live) you may use the service only with the permission of a parent or guardian, who accepts these Terms for you.

6. Your account

You are responsible for your account and for keeping your password secret. One account per person; accounts may not be shared, sold or given away. Give a real email address: it is the only way to recover an account. We may refuse, suspend or delete any account at our discretion, with or without notice, in particular for breaking the Rules.

7. Donations and points

The game is free. Nothing has to be paid to create an account or to play.

Donations are voluntary gifts toward server costs, handled by PayPal. They are not a purchase, not an investment and not a payment for a product or service. As a thank-you, a donor may receive shop points. Points, and everything obtained with them, are a free gift, have no monetary value, are not property, cannot be exchanged for money, and may be changed, reset or removed at any time, for example if the realm is wiped or closed. Points can also be earned by playing. Gameplay power is not sold. Donations are non-refundable except as described in the Refund Policy. Opening a payment dispute or chargeback without contacting us first may lead to removal of the account.

8. No ownership of in-game things

Accounts, characters, items, gold, points and all other in-game data belong to the service, not to you. You receive only a personal, revocable permission to use them while the service exists. We owe no compensation if they are lost, changed, rolled back or deleted.

9. What you post

You are responsible for what you write and do on the website, in the game and on our Discord. Do not post anything illegal, hateful, threatening, or that infringes someone else's rights. We may remove content and restrict accounts without notice.

10. Availability and no warranty

The service is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. It is run by volunteers: it may be slow, contain bugs, go offline, lose data, be reset or shut down at any time without notice. You download and run the launcher and game files at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, the operators, team members and volunteers are not liable for any direct, indirect, incidental, special or consequential damage, loss of data, loss of profit or any other loss arising from the use of, or the inability to use, the service. If liability cannot be excluded by law, it is limited to the amount you donated in the three months before the claim. If you are unhappy with the service, your remedy is to stop using it.

12. Indemnity

You agree to hold the operators, team members and volunteers harmless from any claim, cost or damage that results from your use of the service or from your breach of these Terms or the Rules.

13. Copyright and takedown requests

We respect the rights of others. If you are a rights holder and believe that something on this website infringes your rights, send a notice to the team (see section 16) that identifies the material and your right in it. We will review it and remove or disable material where appropriate, promptly.

14. Changes and ending the service

We may change these Terms at any time; the date at the top shows the current version, and continued use means you accept it. We may end the service, or your access to it, at any time and for any reason.

15. General

If one part of these Terms is found to be invalid, the rest stays in force. Not enforcing a rule once does not mean giving it up. These Terms, with the Rules, the Privacy Policy and the Refund Policy, are the whole agreement between you and us about the service. Any dispute must first be raised with the team directly and in good faith before any other step is taken.
